No. Either acquire permission from the photographer or go take your own photograph.

 

If you say "But I can't take a photo as nice as the one they took!" then that's why you're paying them for their skills and services as a photographer. If you can take a photo as nice as the one they took, then go do it.

The copyright to the photo itself belongs to that of the photographer, even if they don't own the subject of the photo.
