Thats because the CM ML 240 is one of the worst AIO's on the market, let alone for a 8770k. would never recommend their cooler for that CPU. That sounds like a Mounting issue or a lack of thermal paste issue, or both not making proper contact.

is there anything i could do to make it have better contact? or is the aio just trash and i should buy a new cooler

Remount it. Check on manual or YouTube for how-to guides.
