Suing Your ISP?

What would happen if I was to sue my ISP for throttling me? I think I already know the answer but I have viable proof, an FCC claim, and a letter from my ISP denying any type of throttling after I contacted them. I know it would cost me thousands and achieve nothing.

I highly doubt they are intentionally throttling. 

I know (fairly sure)  in my area At&T has a YouTube cache setup, those videos LOAD damn fast, but obscure videos don't load as well. 

YES they could upgrade their infrastructure but thats a whole other problem.

Why do you say that? Connection speeds to Youtube and Netflix are at 2.3-2.5Mb/s while I am sold 10Mb/s. If I use a VPN then I automatically get 9.6-10.1Mb/s on youtube an netflix. They are throttling me

Depends on whether or not they have an arbitration clause. Thats been causing issues for a lot of folks wanting to settle things in the higher courts.

how bad is the throttle they put on you  is it like  10mb to 1kb or just half speed gone . if its like going from 4k streaming to 144p cant work. sue if its 4k to 1080p then its up to you .

another way is go to your congress/senate  people in your area and see if they will help no isp  likes when they start to poke around what they are doing .

 

they can fight it ive heard *cough comcast *cough . but i had optimum online they rolled over after they saw what they had to lose . if you only have 1 isp in your area your SOL from what ive been told they will fight non stop to not let the cat out of the bag at all . saw your said above vpn you get your full speed get the highest lvl of tech support they have bypass the low ones that just spew the useless info . have them replace any cards on the back end that your connection goes thur they wont do it automatically prod them till they do . have a tech check the pole the terms in the poles and the line coming to your house.

 

my connection with fios was all wonky this summer they replaced everything 3x over and it was the stupid card failed in the hub local to me  and no one bothered to check it for 2 months of troubleshooting .  also dont know if you did this try a speed test flash and the beta one html5 version if it comes thur at max speed next try  netflix one next if they comes thur throttled they are then . fast.com  is it

Firstly throttling is not really against the law. The fact of the matter is a US Federal Court all ready told the FCC they can not fine ISP's for throttling users. FCC went to court when Comcast challenged the Fine they got for throttling bit torrent. No ISP guarantees speeds, thats what they can use in court to prove they are not breaking the law. Truthfully not much will happen. Also, if they are the only ISP in the area you could be fucking yourself. What if they cancelled your service and refuse to serve you? 

I just want to sit back and watch the world burn.

There can be technical reasons to explain this also. ISPs peer their networks with upstream providers, multiple different ones, and route traffic differently depending on source and/or destination. By using a VPN you could be getting a more optimal traffic route leading to higher observed bandwidth, this is something I also get with my ISP. I get much better bandwidth to international websites than to local networks which is a little annoying since I mostly use my connection for a site-to-site VPN between houses in the same city, yet I get half the latency and triple the bandwidth talking to a server on the other side of the country or sometimes even to a different country.

 

I would however expect Centurylink being a significantly large ISP not to have observed bandwidth issues depending on route paths and bad peerings to upstream networks, unlike my very small local ISP.

Also this is not a battle you will win ever, not without taking it as a class action with extremely compelling evidence of widespread direct impact, loss of service, loss of revenue etc. Something like this sets a legal precedence and an ISP would rather lose millions fighting this, even if they know they will lose just to delay it or make you give up.

 

ISP's build their networks with over-subscription by design, correctly so. Any legal requirement to actually meet the advertised connection speed to ALL services on the internet is a true definition of their worst nightmare and it is actually something you as a consumer don't want. You'll either force prices up or offered connection speeds down.

The end result would be you finding a new ISP. No company would want to keep you as a client after you sued them, it would be a horrible business decision.
