My build is in my signature. I have the GTX 780 FTW and I had thought that there were some issues with it. I can no longer RMA it has been passed 30 days because I thought it was just in my mind. Now that all these newer graphics cards are coming out, I'm rethinking if I'm screwed or not. My 780 performs the EXACT same and sometimes WORSE then my friends gtx 770 sc. I'm starting to go into denial and I'm thinking that newegg sent me regular 780 acx and sent him 770 FTW lol. But on a serious note I would like to know from your guys' opinions if I am fucked or not!

you're out of the return period, not the warranty. Contain EVGA and get an RMA from them.

Nope, there is a free version to all their products I believe.

There is also some of their programs on steam, check out Futuremark on steam.

You seem to be confused:
Warranty is the period in which if there is a problem with the card, that is the manufacturer fault and not yours, they will either fix it or give you a new card. In your case, this lasts 3 years. These are automatically included with every card purchase (although you can buy a longer warranty if you want).

This is different from the return period in which you can bring it back to the store for a refund (minus restocking fees).

Simple, put your card in your friends computer and see how it works.

So what makes you think it's performing the exact same as your friends 770? There's should be a huge difference in performance so either your friend is lying to you or something else is going on. Maybe your temps are too high causing the card to throttle down. What clocks are you getting while gaming and what kind of GPU usage are you seeing in game? Are you playing with VSYNC and what resolution and refresh rate?
