So my brother lost his iPod at an arena and being dumb he picked up the wrong one from the lost and found and forgot to check if it was his. It needs to be activated but its Apple ID locked. Could I just get an iOS 7 jailbreak and jailbreak it to get into it? If so how could I avoid activating? Or would I have to wipe it and reinstall iOS. Thanks!

Reinstall/restore it. Jailbreak does not do that kind of thing.

Itunes wont let me access it because of the account lock

You're still able to do that if it's Apple ID locked?

I don't remember. My old iPhone 5s could do that but I had it a year ago. Now iOS is locked with Apple ID?

From what I've heard, if it's iCloud locked then the device is a literal paperweight until the original owner turns off the iCloud lock from www.icloud.com or physically unlocks it for you.

Can't be unlocked unless the original owner does so or Apple does it if you are the original owner and forgot your password. 

 

He's going to have to return and pick up the one that is actually his.

 

Off-topic: That's a pretty horrible lost&found if they don't make you verify ownership before picking up something as expensive as Apple electronics.
