Is RATing Prison Time?

Just wondering if it's prison time if someone RATs you. I live in the U.S. so I'm not sure which laws apply here and the guy is in Canada. Might take legal action, not sure yet.

Some are and some aren't depends how they are used. If use maliciously they are illegal, but I feel like it would be to hard to do anything about it unless someone had proof of where it came from.

They just posted the link in a chat to me and told me to download the file. Obviously I'm not an idiot and didn't download it. But he has proof of himself RATing as well. There's a lot more.

Then I believe they could be in legal trouble if forwarded to the proper authorities, I could be wrong internet laws are confusing sometimes.

The easiest way to catch the person is when they use someones information, usually they aren't charged on the computer violation itself.

If the RAT creator target millionaire/billionaire industry, then yes he/she will go to jail because FBI and Law Enforcement will dig up the black mask that is hiding behind the monitor.

If you do like $15,000 worth of damage to computers it is like 15 years in prison.

yes under the US Patriot Act (sec 814) where causing damage or gettign unauthorized accuses to a computer. It's also covered under the computer misuse act here in the UK where i assume the USA has a simliar act in place.

 

here is a break down of the computer misuse act.

Quote

Penalty: Up to six months imprisonment or up to a £5,000 fine. 
Unauthorised access with intent to commit or facilitate commission of further offences, which covers more serious cases of hacking.

Penalty: Up to five years of imprisonment and an unlimited fine. 
Unauthorised modification of computer material, which includes:

Intentional and unauthorised destruction of software or data. 
The circulation of “infected” materials on-line. 
An unauthorised addition of a password to a data file.             
Penalty: Up to five years of imprisonment and an unlimited fine
