If someone signs a PDF with a signature (online) and the person signing it has the intent of screwing the other person over legally/ with the intent of suing the other person, can it happen? For example if my buddy signs a PDF with his mouse (a fake signature) onto a legal document that says I have full access to sell and do whatever i want with the photo he gave me, could the lawyers that are fighting against me say "this is a forged signature, he forged it and should be sent to prison, etc" could this happen? Or is there something protecting me from this happening?

 

 

TL:DR

I got a signature from them, they gave it to me, it was not their real online digital signature, then they sue me because they want money from me and want to go to jail for "forging" a signature to have full access over the picture/game artwork

I don't think any legal action could be taken against you, other than telling you that the terms of the agreement are now void. You wouldn't have done anything illegal, as you would simply be a victim of fraud. All illegal activity would be on the person who forged the signature.

No, the lawyers are suing me for forging the signature, when i did not forge anything.

You didn't create the pdf, you didn't forge a signature, they can't do anything to you.  They need to be able to prove that you did something wrong.

You didn't create the pdf, you didn't forge a signature, they can't do anything to you.  They need to be able to prove that you did something wrong.

They are claiming that the PDF they signed was created by me.

And that i forged the signature.

They remove all evidence of them sending their signature.

Where signature come from?
