will i need to format and will it be activated cuse i dont have a win 7 key cuse it came with my pc

You need to upgrade your current install first and then you can format if you want to.  As long as you activated on that PC you won't need a key in the future when you reformat and fresh install Win10

for some reason when ever i tried to open it it says setup could not start properly and to restart and try again and when it randomly sometimes does open it will still put up the error but i can exit but when i select upgrade it just presents me with a loading symbol than says something happened and closes

this has nothing to do with what i am talking about

Yes it does. Unless you've had the notification that Windows 10 is ready to install, it isn't ready and you shouldn't upgrade it through the tool you downloaded.

It's more the people that weren't getting the notification that went on to force update it, rather than waiting, not knowing they didn't get the notification because the drivers for their hardware aren't ready.
