Gtx 970 proformance drop?

Hello there, I have a problem with my gtx 970 g1 gaming from gigabyte. I have noticed a performance drop in my card. I can not run games at the same fps that I used to with the card, and I checked a bench mark of tomb raider, copied the settings and got 80ish fps while the other person got 120 fps. Also I have noticed a drop in other games. My card isn't thermal throttling in stays under 80c and according to msi afterburner the gpu usage isn't limited to a certain percentage. I bought this card to run gta v at high settings at 1080p 60fps with good frame rates and if there Is a drop it would be very sad because the card isn't cheap and I don't know what to tell gigabyte or if the warranty covers performance drops. Just asking for some advice to all you good people thank you very much.

Try running some benchmarks IE Unigine Valley and see if you get the same framerates as other 970 owners.
