I am not sure what the consumer protection laws are with Ebay but maybe call them and find out?  Mention what it is you are looking at buying and discuss it with them.  Also look at the rating of the person selling the item helps too.  Still for me when I buy used I buy local and it has worked out for me well.  I deal with people I can trust and now with me looking at items that would cost much more than what I bought before I definitely would be asking to see them tested out before handing over money.

Too many ****ing games!  Back log 4 life! :S

If you can return it, I say go for it. I've been using a used R9 270 for over 6 months with no issues. (I even have a second used one coming in the mail.)
