Not at all. Motherboard choice barely matters for OC level now unless you go ridiculous/extreme which you will not.

 

All updated asus H81, H87, H97 and B85 support OC'ing for one and there are other brands which have followed this to an extent.

 

If you want to be completely safe on OC-ability then get Z97

It might sound a bit stupid but i have a i7-4770k but I really don't want to spend more than 100$ on a mobo xD and still i wanted to oc for about 4,2Ghz xD it dat possible ?

You can get a cheapo z97 motherboard.

what does budget gaming means ? unlocked pentium or i5K? 

 

It might sound a bit stupid but i have a i7-4770k but I really don't want to spend more than 100$ on a mobo xD and still i wanted to oc to about 4,2Ghz xD it dat possible ?

Easily. MSI Z97 PC MATE. It's not the best looking nor does it have a TON of features but it will get the job done easily.

I know, but I don't like to recommend it because Intel could close this "bug" any time they want.

It's not a bug at all. Also no they could not. You need to hardlock OC'ing in the chipset to prevent the unlocking of OC's on lesser chipsets.
