If a seller posts as a title "Razer Deathadder 2013 edition" but in the picture shows a 2012 edition and i order the mouse assuming it is the 2013 edition like the seller said but it turns out to be the 2012 edition who's in the right and who's in the wrong?

 

The seller could make the complaint "the mouse is different that what it showed in the picture" or "the mouse is different than described".

you would ask to seller before buying or after committing and before paying whether or not it is a legitimate 2013 version or not

The wise thing to do would be to send the seller a message stating that the description and picture do not match and you'd want them to clarify. If they say it is in fact what's described, but with a diff photo (which is kinda sketchy since they could have used a stock photo of the damn thing) and you feel like taking their word, go for it.

 

If they did lie, you take it up with ebay and after playing the game of going back and forth, you bring up the logs of your messages and a screenshot of the description. Ebay will approve it's fraud and refund you.

 

I personally wouldn't trust a seller showing the wrong product photo if a stock image is piss easy to find. Seriously, if you're going to sell a product, take a bloody photo of it.

Scammers get away with scaming people this way, because some people who aren't observant just look at the picture instead of reading the description. 

 

Item description still wins.

@TheNinjaNextDor and @helping are correct, description is the ruling factor in an eBay listing, a listing does not even require a picture in order to be valid.

 

Personally I would not buy an item from a seller who could not be bothered to find an image of the correct item.
