If it was to be sold, it should have gone through an FFL and not with a third party across state lines. Not going to say this sounds sketchy on their end, but it sounds a little sketchy. Only the actual owner of the firearm should be selling it, not an agent.

Looking to buy a gun, but want to make sure all parties follow the guidelines...

 

I live in and resident of Georgia.  Seller lives in and is resident of New York.  Gun is in Georgia with a friend.

 

How do we enact a sale?  I am reading handguns that cross state lines have to go thru an FFL.  But the gun is located in GA already, can his friend act as agent?

The seller must be the legal owner of the gun in order to sell it. It can cross state lines with the appropriate paperwork that is up-to-date. If you are unsure, you can ask your local law enforcement. If seller fails to produce the paperwork needed, do not commit to the sale and report it. The seller must have sent you the paperwork to transfer licenses first.
