Consoles are custom designed computers that do one thing, so we usually have to wait for a much more powerful general purpose PC to be able to emulate a console. Emulating is very legal, Bleem! And Virtual Game Station were sold at a retail level. Sony, Nintendo, Sega teamed together and tried to make sue Bleem! and Virtual Game Station  for damages and lost in both cases, but they bankrupted Bleem! and Connectix

Emulation is legal, some emulators use HLE bios like PCSXBOX on the original XBOX not requiring any remnant of the original PS1 console, all you need is to rip your PS1 discs on your PC and FTP it to the XBOX, it's very legal.

the emulator itself is already illegal, and the media is still obtained via illegal means. torrenting a movie also isn't allowed to be discussed here, even if you own the movie.

Emulators are completely legal.

Obtaining your own Bios is legal if you own the hardware.

Ripping your own games to your HDD to play on an emulator is legal because you own them.

 

Perhaps the disc is in bad shape and the console no longer reads the disc, downloading an image of the same disc is not illegal.

Emulating a system with games you own in order to preserve the hardware is not illegal.

 

Hosting content that can be shared for the purpose of distribution is illegal, however it is then at the hands of DMCA.

The issue is not the exact legalities of emulating but the way it is used, torrenting a game without paying for it is completely illegal and is not morally right, emulation of something you already own, although not to the letter legal is completely acceptable.

The Wii U has an emulator and it works quite well. Only "current" gen console that is available as an emulator and that is likely because it is sooooo outdated compared to the others.
