According to Arstechnica retailers will be contacting customers via email about how to make claims. 

Apparently NewEgg is the first to do so.

 

I would give it a few days before worrying about anything.

Another thread says 980 and 980ti users got an email as well. I think it's most likely a fluke by newegg. I haven't heard about any other lawsuits for the 900 series.

I have a 4GB GTX 960 along with the 970 that had come with my prebuilt before I replaced it with a 1070 at the end of June.

 

If the 970 had that 3.5/5GB issue with its 4GB then wouldn't a 4GB 960 have the same issue?

No. The crossbar on the 960 is intact.

 

What I think may have happened is Newegg used a VERY BROAD item code (like a UPC) and it came up with literally everything under Nvidia 9xx.

How is it that the lower tier 960 didn't get messed with but the upper-middle tier 970 was?  I'm not saying you're wrong about the 960 but rather I'm just trying to understand why the 970 was affected but not the 960.

I'd the 960 had the same issue it would have been figured out around the same time as the 970's was.

The 980 and 970 share the same GM204 (I believe it's 204) where the 980 has the full core enabled (same thing all chip makers do by binning) but the 970's GM204's are dysfunctional in the ROP's, crossbar, and the 0.5GB segment.

 

In contrast the 960 and I think the 950 are GM206 (I can't quite recall it) and were likely unaffected by the GM204's issue.
