What is the better CPU, 'gaming' wise...

i5 6400 because of its much more powerful single core performance, which makes it a better choice for gaming. Not to mention it consumes less power, has a better upgrade path (AM3+ is a dead socket) and utilises DDR4 RAM.

Take the i5, then disable Turbo Boost and set its multiplier to 33 so it always runs at 3.3GHz instead of 2.7 :)

6400 demolishes the 8350 hands down. Just make sure to get the fastest memory that you can within reason. You don't need, say, 3300mhz memory, as 2400 or up would be fine to help relieve any CPU bottlenecks that you may experience in some titles (which are unavoidable in any scenario when comparing modern CPUs).

Do you think I'll be able to overclock to 3GHz with the stock cooler?

Absolutely, keep a watch on temps, but unless you touch the voltage the difference in dissipated heat will be pretty small.

 

I do recommend controlling the fan via the BIOS / with software
