If the seller has paperwork you should ask to see it and then I recommend inspecting the tablet when you meet up as per the instructions on the recall site: http://tabletrecall.expertproductinquiry.com/
In the settings you can see the battery type and also the serial number and compare to what is on the paperwork.
The original tablet is supposed to be deactivated when the new one is turned on, but a simple root and package removal can block the remote deactivation. This process also blocks GRID and any OTA updates from getting to the tablet. If you reinstall the package, the device will likely be bricked. So make sure that it is NOT the original unit unless you know that and don't care. Though I do not recommend you use a device that could potentially catch fire.
EDIT: if the shield has MM on it then it is likely the new unit.
