If you can figure out how to make a DVD player download and seed torrents then sure, you would by definition be a hacker because you are changing the DVD player's firmware in order to make it do something that it was not intended to do.

If they are using hacks, even basic script hacks, then they are by definition "hackers".

making a gourmette pan out of a toaster is also hacking, hacking = doing something with something that the maker of said something didn't intend
