Is Windows activated? I don't believe it will let you get updates until you activate windows. It should have done it automatically but you should check.

it is active and working properly! it is a genuine windows install

Are you getting an error with the windows install? Also have you checked your event viewer for logs pertaining to the issue?

1) Do you have an internet connection?

2) Is the windows update service running? (Press WIN + R keys and type in the run bar "services.msc" without quotes, in the open window, scroll down until you see windows update and double click on it and in the field where is says "startup type" make sure it is set to automatic and try starting windows update.

Hope this helps

Happened to both Win7 clean installs I did. Running windows update just says checking for updates and stays there forever. After like 5+ hours, it finally shows the updates. -_-

But when I click to download, it just installs, so it possibly be it's downloading in the background, even though it just says "checking for updates".
