could i download windows 10 onto a flash drive to install it on a new pc rig that I have not yet built?  This would be great information to know (even though i dont believe it would work).

not unless you buy a 10 key

otherwise you have to upgrade from 7 or 8

Yes, but you'd have to buy a windows 10 key.

 

Otherwise you'd have to install windows 7 or windows 8 depending on what you have a key for then upgrade. (Though I wouldn't suggest upgrading unless you're alright with M$ keylogging you, watching you through your webcam, and listening through your microphone among plenty of other things as well...)
