If you really feel that strongly about Microsoft "lying" about it, then why don't you make your case then instead of saying "someone should sue them". And it is technically magnetic if you include the battery they included.

no i hav not been drinking 

take out the battery from the pen 

then see if it stick to the tablet/dock
