Can I sli the evga gtx acx 2.0 970 with the Gigabyte gtx 970 g1? I already have the evga, so please dont suggest a different card setup. 

Yes, as long as they're the same GPU (GTX 970) then it's perfectly fine, card variants and brands can be mixed in SLI.

Yes they do, but you can just overclock one to match the other. It'd be better just to get another evga one to match cause it'll be a little of a hassle and fugly
