It depends on where you're buying it from. If you can test that the cpu works, it should be fine. Cpus are unlikely to just fail once you determine that they are in working order.

CPU can't used in mining right, i know it can but you get what i'm asking..

So would i buy USED CPU maybe i5 or i7

Well, there is always the chance that it has been over heated or borked from overclocking, but if you buy from a trustable/non sketchy seller you should be fine. Just make sure it isn't jacked up in any way.
