lol just bend it back into place, I bend my D14 all the time to unscrew it or clean the center fan its still working.

How could this be out of the box? The fan that comes with the cooler is packed in the middle of the heatsinks right?

Yeah which means it was either used or the center fan was stolen.

Bought it used... but it was packed fairly well. someone must have used it as a stool during lunch break or something :/

Yeah you can bend it back into place, just don't over do it though. I've bent my D14 alot to work around it in my old case and its still good, just as long as none of the fines are badly damaged you will be good.

Edit: btw i managed to get it kinda straight again but its still slanted to one side because the heatpipes were bent at the bottom where they curve..
