So I've been messing around with project spark and cryengine, but i dont like project spark because its kind of limiting, and i love cryengine, but it seems apparent to me that even though it is possible to make a third person game, it would be a pain in the butt because its more of a fps engine. What engine could I use to make a third person game but have the ability to switch between first and third person at will fairly simply? I want it to have elements from games like assasains creed and tomb raider, but be able to switch it into classic fps mode at will, kinda like skyrim. Any ideas?

Unity is probably better for you, its free and you can try it out for yourself. Also theres more documentation for Unity.

Darkplaces is an open source engine (think Quake on steroids).  I used to play Nexuiz 2.5.2 which used it and there were some setting for first and third person.  You can even get a blender addon that uses this engine for rendering.

For an indie, I highly recommend Unity3D or Unreal Engine 4. If you don't want to pay for your engine, there's a free version of Unity3D and the Unreal Development Kit, both of which have TONS of tutorials and tips all over the internet.

I started with Unity, then moved on to CryEngine. It's not as hard as you'd think to make a 3rd person game, all you have to do is change the way the camera is attached to the "Player" actor. After a while, I found CryEngine to be an optimized mess, so I tried UDK. It was pretty sweet, so I bought UE4. Haven't looked back since.
