 I will be using this to game at 1080, and watching netflix. How does it look? any help will be greatly appreciated. 

Looks good to me so far. Might be a bit of a few changes I'd do, but without going into much detail, If you're not overclocking (non-K i5) I'd rather swap out the board for something cheaper, and get the Xeon E3-1230 V3.

I'd leave it like he has it. I wouldn't change to Xeon for gaming.

... why would he even get the Xeon..... for gaming the i5 will crush the Xeon and why bother? that i5 will be more "future proof"

Not that much more expensive then the 4690 non-K, but actually it's more "future proof". It's basically an i7-4770 non-K running 100MHz slower, and without the integrated graphics.

Budget?

looks good, i just suggest going for a "Z" Motherboard so that you wont be held back to up to an unlocked i5/i7

Why not? It's the cheapest quad core hyperthreaded cpu that Intel has. Pretty much an i7 without the inegrated graphics.

nope,case and headset are not inc in budget, they were gifts :)

also, when im looking at the OS on pcpartpicker, they have 2 of the same at different prices. 

windows 8.1 oem (64 bit), then another windows 8.1 (64 bit) (oem) (64 bit), is there a difference?

 

It appears that Microsoft Windows 8.1 (OEM) (64-bit) - WN7-0615 despite the title is a full version intended for enthusiast builders. While the other is for people building & selling systems.

An ssd would be a big plus.
