Best way to approach an intel RMA?

Long story short, I purchased a 9900K second hand and it appears to be faulty, won’t get past the windows logo on optimized defaults. Spoke to the seller he has been very cooperative with the situation and offered for me to return it. It was purchased in Feb 2020 and he gave me the receipt pdf. How should I explain the situation to intel for the highest chance of getting a replacement? I would much rather get a replacement from them than going through the second hand market again.

Per their policy, Intel does not honour warranties on second hand processors, and typically only warrenties the chips for 3 years.

Return the chip to the seller. There is no way Intel is going to honor their warranty since it's second hand, and as @svmlegacy mentioned, Intel only offers a 3 year warranty on the processor. 

 

You're better off getting another one (I don't know why a 9900K->) or upgrade the CPU platform.
