Does that mean before i pay money to this company(LogoDesign), i still even have to check whether their logo has already been trademarked on TESS database?

Also, i did buy a logo from their website just for permission to use, and already upload my logo on my website, but if somebody buy faster than me, would i be in trouble? or i just no longer allow to use the logo after someone purchase the copyright of the logo?

This just means you can't register a trademark for a logo that is already registerd, or for any logo build with a logo maker.

If you want to register a TM, it needs to be yours, you need to have the copyright, it needs to be unique and not made with a logo maker

to trademark a logo it needs to be all of the following:

- unique (as in, not close enough to other brands' logos to be confused. for example having a logo with a beige F on a cyan background would be too close to the facebook logo.)

- the full copyright ownership of the logo needs to be in your control. (so if you use any sort of software to make it, they must give you the full rights to the image created.)

 

but really.. if you're using a logo maker to make any logo you're investing in.. you're doing it wrong.

paint exists, gimp exists, friends that'll cobble something together for a tenner exist.

 

especially when starting out, there isnt too much science behind a good logo. all it should be is recognisable.

Sounds like the website/software has bunch of premade templates/designs. So those designs are in their control, and apparently you can't buy it. Probably in order to keep the service possible for more customers.
