It's probably your CPU or RAM bottle-necking the transfer. The NVMe drive probably only has access to half of the PCIe lanes assuming you're running a GPU as well.

You sure you are using a usb 3.0 port? 38MB/s sounds awfully like usb 2.0 limited speed.

Could it possibly be because I have the flash drive in the USB 2.0 port rather than the 3.0 port?

Definitely since about 40MB/s is the max USB2.0 can do.
