Isn't it illegal to sell these without consent from Sony? Those things are basically guarded like IP.

Just about, at least when the console is relevant, unless they're bought out by a bankruptcy sale of some sort. 

I say "when the console is relevant" for a reason, because generally speaking, console manufacturers don't care if they're really sold when there's no support for the console anymore. Hell, PS2 devkits are impossible to find because Square Enix snapped up a ton of them off of eBay to work on one of the Final Fantasy games.
