  1. Since my replay and recording functions from Geforce experience always turned off when I open my Browser (since the driver update 487.09) I investigated this further. The browser (Opera) was not the problem, I opened Firefox which had no effect on it before, but when I opened the Spotify webplayer the overlay message popped up that my replay is turned off and I wasn't able to turn it back on until I closed Spotify. The music mafia really knows no limits when it comes to protecting copyright. I hope this helps people who couldn't figure out why it turned off like me.
  2. I have quite a few songs and I like streaming on Twitch. I have noticed SOME songs get muted in the VOD the next day. - Meaning the muted songs were in the Twitch DMCA database and auto-flagged for being copyrighted music. Is there a way to check beforehand where the song will get muted in Twitch or not? - surprisingly, not all songs (including mainstream) get muted, it is only some. This includes songs that aren't on the Royalty-free playlist.
  3. Summary Nintendo issues a cease and decease order against super smash Bros tournament franchise "the big house" due to the use of fan made technology that allowed their 20 yr old game to played online using rollback netcode. Quotes My thoughts Nintendo is once again flexing their legal arm against the use of modding and emulation of their software. One reason this is important is because its happening during a global pandemic and this fan made tool allows an event that hosted 3000 people the previous year in 2019 to be played online where people can be isolated. Also not only has Nintendo taken down the tournament but has also sent cease and desist to past tournaments that were already held to take down the YouTube and twitch recordings of the matches played with this technology. This can create a huge precedent for companies that want to be overprotective with their IPs to crack down on gaming communities that thrive with the use of modding and emulation as well as the implications of how much control can a game publisher have in the context of eSports. A similar incident happened 2 years ago with Toei and Capcom and the game Dragonball fighterZ Sources https://gaming.ebaumsworld.com/articles/nintendo-issues-cease-and-desist-letter-to-fans-twitter-explodes/86457489/ https://www.gamespot.com/amp-articles/super-smash-bros-melee-online-tournament-canceled-by-nintendo-cease-and-desist/1100-6484683/ http://shoryuken.com/2018/12/24/maximilian-speaks-out-on-dragon-ball-fighterzs-alleged-copyright-issues-and-tournament-woes/
  4. In some minor tech news ( as its kinda relates to youtube/twitch LINK = PCgamer.com link Pewdiepie used a racial slur while livestreaming PUBG, as a direct reaction to this Sean Vanaman, Co-founder of Campo Santo creators of the game "firewatch" (good game btw) posted on twitter that he would be filing DMCA take downs on pewd's videos of their games. Do you agree? Are creators now able to retroactively remove content of other channels and risk legal action, because they don't like something the host said (has happened with sponsorship's I know). Would like to hear your guys/girls thoughts on this... I hate pewd's personally but I dont like that kind of content, but I think a DMCA is abit of a streach removing permision AFTER the fact ( reminds me of that rape thing that happened awhile ago, wheres some extreme feminists were wanting to take back consent after the fact) (To save you clicking) QUOTED FROM PCGAMER YouTuber PewDiePie – who lost lucrative partnerships with Disney and YouTube earlier this year due to an anti-Semitic video – has used a racial slur during a new livestream. The wealthy (and regrettably influential) personality uttered the slur during a livestream of PUBG, and while it has attracted condemnation online, Campo Santo co-founder Sean Vanaman has indicated he will take further action. "We're filing a DMCA takedown of PewDiePie's Firewatch content and any future Campo Santo games," Vanaman wrote on Twitter. "There is a bit of leeway you have to have with the internet when [you] wake up every day and make video games. There's also a breaking point." He continued: "I am sick of this child getting more and more chances to make money off of what we make. He's worse than a closeted racist: he's a propagator of despicable garbage that does real damage to the culture around this industry." Vanaman made a call out to other developers to take direct action against the likes of PewDiePie. "I'd urge other developers & will be reaching out to folks much larger than us to cut him off from the content that has made him a millionaire. Furthermore, we're complicit: I'm sure we've made money off of the 5.7M views that video has and that's something for us to think about." At the time of writing, PewDiePie's lengthy Firewatch playthrough has been removed from YouTube, though Kotaku reports it had been viewed 5.7 million times already. Here is the clip, thanks to @TorqueS Warning some users may find this offensive ( and if you do...yeah.....) https://oddshot.tv/s/g_05U6 Video of copywrite attorney Leonard French giving his thoughts on the matter ( thanks to @Energycore for directing me to it ) https://www.youtube.com/watch?v=uhn6yrNzM3M Sean Vanaman's twitter reads as follows
  5. Because this story is quite long, I will try to give you a short version. There is a lot of information out there, so if you want to learn more about this, please do your own research because I might have missed something or interpreted it incorrectly. I first heard about this story from SidAlpha, a youtuber who makes video about gaming news and industry analyses. He managed to get in contact with TotalBiscuit so that the story would get heard by more people. Leeonard French who represents Imagos also made a few videos about this, and I both Leonard French and SidAlpha got death theats from Alex Mauer in the process. Alex Mauer was hired by Imagoes to make the sound effect and/or music in the games Star Mazen and River City Ransom Underground. She had some sort of falling out with the company and claims she never signed any documents (her coworker did), therefore Imagoes does not own what was made and put into the game. In what could only be called a attempt to get publicity around this, she decided to manually file DMCA takedown notices on any video she could find on Youtube that had gameplay video in it. Everything from reviews to lets-play videos; affecting over 100 Youtube channels. After some time Alex Mauer realized that flagging all of the videos at once would only yield a single strike to a channel, she decided to take away some of the claims, just to reclaim then again on channels that had more than a single video. This made it so that Youtubers who had made a few videos about these games could and would get taken down by the Youtube system. Alex Mauer was taken to court by Imagos and given a restraining order against filing anymore DMCA takedowns, and the legal battle between the two parties are currently ongoing. Both Destructoid and ArcTechnica made stories about this, but they decided they wanted to side with Alex Mauer in their stories. Both have updated or changed their entire article after posting it after other news outlets called them out on it. Articles can be found here: https://www.destructoid.com/blogs/Jonathan+Holmes/river-city-ransom-underground-taken-off-steam-due-to-dmca-claim-449177.phtml https://arstechnica.com/gaming/2017/07/dmca-takedown-takes-river-city-random-underground-off-steam/?comments=1 GamingReinvented and OneAngryGamer acticles about the misreporting: https://gamingreinvented.com/news/destructoid-covers-alex-mauer-writes-hilariously-biased-story/ http://www.oneangrygamer.net/2017/07/gamergate-destructoid-updates-article-after-misreporting-alex-mauer-dmca-case/35232/ Vidoes covering the subject in more detail: TotalBiscuit: youtu.be/077d3hAvwQ4 Leonard French: youtu.be/nuSZ6wZAaHQ youtu.be/ryWjMNVb3sI youtu.be/IF1jZ4ompUU SidAlpha: youtu.be/i15_OLOXLmo youtu.be/wbIgvJevawo youtu.be/5eTLpjRE8QY youtu.be/2odeBDCP6Kk youtu.be/-xixllqAgdE youtu.be/qC_BXWx9s6Q youtu.be/3GEP-g4gWTA youtu.be/K1dmsHP2HEo youtu.be/OnLZVmMLM3M youtu.be/dUEECgeBMg0 youtu.be/WXhx7r1nqgI youtu.be/eq8zd82MqwU youtu.be/ViGdap10YDk youtu.be/tB272wsWfrg youtu.be/KER7j-vEzzM youtu.be/2j7aUzBh4SE
  6. Please remember the Community Standards (that I hope this post abides by too) Source 1: https://github.com/Cruel/freeShop Source 2: Imgur mirror: Source 3 that is 3 paragraphs too long: https://www.engadget.com/2016/12/29/nintendo-dmca-takedown-freeshop-3ds/ And final source 4: the actual DMCA application document thing https://github.com/github/dmca/blob/master/2016-12-27-Nintendo.md So, in order to fully understand this, you'll need some background info on the 3DS homebrew/hacking/CFW scene (skip if you know about it) if you have time, watch the video that a few of the prominent 3DS hacking developers did last year at 32c3: https://www.youtube.com/watch?v=bZczf57HSag 1h12m long though, and the current one at 33c3, which is an hour long, and I haven't watched since I'm on vacation. https://www.youtube.com/watch?v=wogNzUypLuI basically, if you have a certain level firmware, you can do some stuffs that make it so you can install custom software/programs like a Save Backup/Injector, FTP server, and Streaming to your PC. These apps are in a ".cia" filename extension. Freeshop was one of these aps. Background on how the eShop works: when you legitimately buy something there, you get a "ticket", a jumble of hex digits, that you tell the server "hey, I have this ticket, one game please" and then you begin downloading it from the server. However, that ticket, ISN'T UNIQUE PER PERSON/TRANSACTION. It's one global ticket per game. 1 ticket, 1 game. So, if there was a way to get unauthroized access to the game files, you might be able to extract the unique key per game. And if you upload it to a website, you might be able to download the key, and download the game directly from Nintendo's servers, just as if you bought the game legally. And perhaps there is a nice GUI application right there on the 3DS that manages it all for you..... That's what FreeShop did/does. To be clear, FreeShop doesn't host the Title Keys themselves, you have to manually input it, or use a separate website that hosts them for you. FreeShop can access that website and download the keys and manage it itself and download the games from the keys. FreeShop has legitimate use, if for some reason the eShop doesn't remember that you purchased a game, then you can download it again. ===================== New info here: Nintendo said "stop hosting that program on github, here's a big fat DMCA to shut you up for good" (which, Nintendo has been very liberal with in general over the past couple of years), and Cruel, had to bend over and just take it, not really much recourse Ninty is totally in the right to do this, but why has it taken so long to do so? It's not a new hack/exploit, and patching the integral part of it would require a rework of the whole ticket system. Maybe this is more heavy handedness after the Permabans of early Pokemon Moon leak, users (which also effected people who got the game early because Amazon shipped it early or something). This doesn't stop any mirros of the .cia file from working, just that specific github release (and all(?) forks of it too) from existing. If so, then everybody that has "FBI" (a commmon 3DS hacking program) on their 'currently playing' thing, then they might be banned too. I don't know. But if this is leading to more harsh punishments on Hackers, then I'll start the popcorn machiene now, and watch /v/, /r/3DSHacks, and other forums burn up in flames and say how it isn't fair that Ninty punish Hackers with CFW (custom firmware)
  7. Source: Motherboard TL;DR: If successful, a lawsuit from the Media Industries could force ISPs to heavily monitor users and potentially ban them from Services. Media: Quotes/Excerpts: My Thoughts: With the recent victory against a smaller ISP, the music industry has a potential precedent for future cases that could easily force them to go the same way. While the industry hasn't challenged any of the big players yet, this is definitely something we should be watching.
  8. As a part of the three year review of the Digital Millennium Copyright Act (DMCA), the Museum of Art & Digital Entertainment (MADE) is petitioning the US Copyright Office to allow for abandoned games that rely on a connection to online servers to be excluded from the anti-circumvention provisions. Essentially, once a game company shuts down a server to a game that requires an internet connection to be able to play, people and museums would be able to preserve the game for future play. https://torrentfreak.com/gamers-want-dmca-exemption-for-abandoned-online-games-171221/ My personal take is that if a game company abandons a server necessary for the playing of a game that I have purchased, then there should be tools around for me to be able to still play that game. This is especially the case as more single player games are relying on server connections for validating DRM licenses (looking at you Denuvo)...
  9. Hold on to your butts! The Electronic Frontier Foundation has filed a lawsuit against the United States Government over the Digital Millennium Copyrights Act. (Otherwise known as that horrible piece of legislation written by morons who don't know anything about the internet, computers, or how things should work). Further Reading Source: http://arstechnica.com/tech-policy/2016/07/eff-sues-us-government-saying-copyright-rules-on-drm-are-unconstitutional/ It's about frigging time. The DMCA has long been a thorn in the side of the internet. And while yes, people do need to be able to protect their intellectual property, I feel we can all agree that the DMCA does it in a horrible way that basically assumes guilt on the part of the accused, and overall is rather easy for companies to misuse (Without and penalties for misusing it, as far as I am aware. If there are penalties please feel free to post what they are and how they work). As you can no doubt tell, I am biased here. But still I like to think we all agree that the DMCA needs to be trashed, and something fresh put in its place, maybe written by people who actually understand the internet, how powerful a tool it can be to inform and educate people, and who are also aware of the disturbing frequency with which copyright laws are abused Thoughts? Comments? Roaring Applause?
  10. Sources: https://account.mojang.com/terms#commercial Explaination: So basically mojang which is now owned by microsoft started sending out emails to everyone who owns minecraft server(s). The content of which is available here: https://www.spigotmc.org/threads/eula-dmca-requests-being-sent-out.125792/ What this means is that previously you could sell pay2win goods in the game and now they're enforcing a complete 180 and saying that is not allowed anymore Opinion: I could see why they would do this, that makes game more appealing to the audience as it is more fair, but starting it out right now is not the ideal situation as this change would reduce profits dramatically. For example if youtube issued that promotion on the videos is no longer tolerated and that you should only profit from ads instead, that would be a fairly similar situation. Makes video content more appealing to the user as there's no promotions on it, but hurts the content creator(s) incredibly. For those of you whom this is completely irrelevnt, I apologise for wasting your time with this but if you do find this relevant or know anyone else who does please do share it so that everyone is informed about this Feel free to leave your opinion at the bottom, I'm quite curious to see what people think of the situation here
  11. Source: http://www.shacknews.com/article/95540/ford-copies-firewatch-official-art-for-freedom-sales-event-promotion Reddit: https://www.reddit.com/r/pcmasterrace/comments/4q6oxx/ford_copies_firewatch_official_art_for_freedom/ DISCLAIMER - THIS IS NOT AN INDIVIDUAL DEALER'S FUCK UP Ford will not even admit to the copyright infringement as a "mistake" which it is not. This is beyond despicable, there are numerous sources proving the art is from Panic Inc, the developers Co-Producers of Firewatch, and Ford is outright denying it and claiming it is their original artwork! Panic Inc have responded on twitter but I hope they sue since Ford is actively denying infringement claiming the artwork is their own when everyone knows that's complete bullshit.
  12. Source: The YouTube Link Where to take action: https://www.takedownabuse.org/ You have 30 Hours from now to help make an impact! The DMCA was created for a 1998 internet, now almost 20 years later, there is no argument it needs to be updated. The DMCA has been a pain for a long time for many people, especially content creators on the internet, With YouTube being a great example. After a lot of complaining on Social Media and other forms, with movements such as #WTFU (Wheres The Fair Use), the US Government has decided to start listening, and wants your feedback on how they can improve the DMCA. Talk about how it effects you (if you're a viewer or a content creator), explain ideas of how they can modernise the DMCA. Here's the kicker, the deadline is April 1st 11:59 EST (No its not an April 1st Joke) Time is running out and action needs to be taken, now. My Opinion: Basically what I wrote above, those are my words. There is no set article for news. But this movement, I would consider News Worthy. Your Opinion, Please leave it down below! Edit: Some background on the DMCA: Edit 2: To prove its not an Aprils Fools Joke, its even on the Federal Register: https://www.federalregister.gov/articles/2015/12/31/2015-32973/section-512-study-notice-and-request-for-public-comment Edit 3: For those who said it closed on March 21st 2016, there has been an official extension: https://www.federalregister.gov/articles/2016/03/03/2016-04641/section-512-study-extension-of-comment-period Edit 3: Added Screenshot of official Extension of time from the Federal Register:
  13. While they're comments were long and winded and very legal, basically Youtube has finally heard the cries of so many creators who get their videos unlawfully taken down by copyright holders. Creators do this (especially game devs; go see Jim Sterling) all the time when reviewers put out bad reviews. It can scare reviewers and creates mistrust in the system. When all the bad reviews are taken down, how can we trust the good reviews? It's total BS. In response to this Youtube is picking a few cases that they think have the best chances of winning in court (they can't fight every case), and is offering up to $1 million to cover legal fees. They hope that the few cases they fight send a message to all copyright holders that they too must follow the DMCA. What do you think? Is it about time? Or is it still not enough? Here's the article: http://edm.com/articles/2015-11-19/youtube-offering-legal-protection-for-takedowns
  14. Source: EFF (Electronic Frontier Foundation) (Archive in case it goes down) Restoring old games is hacking, and all hacking is piracy, and all hacking is illegal!.... Right? (WRONG) You smell that? Yeah, it... smells like bull. No, it's not April 1st, I've almost got no words for this. This has to be the worst thing I've heard this year, at least so far. This is no different than the patent trolling that goes on in the industry, people like this keep relating things to piracy to stigmatise and scaremonger. Regardless of whether they're right or wrong in saying that hacking old games is piracy or not (which they are completely incorrect in saying) it doesn't matter, the general public will believe them and the consumers will not get any support. It's almost as if they care for nothing aside from money and business, it's like they become enraged when they see people doing things for free. I'm done, here's the quotes from the article. "The Entertainment Software Association doesn't want anyone to restore the functionality of older videogames that are no longer supported by their publisher, because, says ESA, this is "hacking," and all hacking is "associated with piracy." "Behind this hyperbole, ESA (along with MPAA and RIAA) seem to be opposing anyone who bypasses game DRM for any reason, no matter how limited or important.
  15. Spoof or joke, Western Union wasn't going to be amused and decided to fire the big guns at a Facebook user where he posted a single Bitcoin-themed picture, parodying a company's banner ad. Beside the Streisand effect, the DMCA take down notice filed by the money transfer giant didn't cause much additional damage. Source: Western Union doesn’t like Bitcoin spoof
  16. Youtube-DL DMCA'ed by RIAA Summary Youtube-DL and all it's forks have been taken down from GitHub by DMCA takedown notice from Recording Industry Association of America. Quotes My thoughts I'm not surprised that this has happened as I have been surprised several times just how powerful Youtube-DL is. I think it's kinda stupid to show stuff like music videos as examples as for example RPCS3 has received DMCA takedown because they mentioned Persona 5. However I believe that this is abuse of DMCA as Youtube-DL is 100% original work. Sources https://github.com/github/dmca/blob/master/2020/10/2020-10-23-RIAA.md
  17. Initial news broken by Video Game DataBank (Link: ) The individual above has noted some severe issues with Amazon support, particularly in regards to presenting and warning people of bugs and issues with the game and patches. The above noted fellow found a bug in the games skill-leveling mechanic and had an issue where the support team did not understand what he was talking about so he linked a video that he had made to warn the community about the bug in question to attempt to prevent anyone from wasting their time, real money and in-game money on a buggy part of the game. A few hours later, the video was manually DMCA'd by Amazon.com Services LLC (Seen below): If this action was completed by amazon, I am in agreement with AsmongoldTV that this will be a terrible precedent for gaming journalism as all the other gaming developers will see amazon getting away with this and begin hopping on the bandwagon. As we've already seen in recent months from court cases and various revelations from former staff, all these large gaming companies have extremely dubious track records and will absolutely jump at the chance to be able to remove negative or potentially negative content, in order to falsely lure new customers into a seemingly 'perfect' game, the new customer being none the wiser that the game could be incomplete or full of bugs, but the content developers on that particular title no longer cover such topics out of a fear of losing their careers. Edit: To add, I found a thread on new world subreddit discussing this and apparently they're also outright ignoring any issues that almost any players have, apparently AGS support is hot garbage. This is from a fellow who was banned for reporting a hacker, and then AGS live chat confirmed it was a mistake and then his ban appeal was denied and they refuse to talk to him anymore. For more: Lol the thread is pretty spicy:
  18. Summary "Workers & Resources: Soviet Republic" is a still-in-development city builder where you, as the name hints, build your own republic and planned economy. A recent update introduced a 'realistic' mode where all resources must be either imported off-map or produced on-map, transported on-map, and on-map manpower used. After an earlier update, and as a 'realistic' game-mode was being created by the devs, a fan of the game compiled a guide for a "Cosmonaut Mode" - their version of 'realistic.' The guide was popular enough to have the Devs offer to add the author into the game credits as a 'Thanks for supporting us' type of thing. However, the devs wanted to wait until the final product to add them to credits while the fan wanted to be added immediately. This disagreement resulted in the fan, who is themselves a lawyer, filing numerous DMCAs and take-down notices against the game and other fans. This resulted in numerous youtube videos taken down and the literal entire game being DMCA'd off of Steam. Quotes My thoughts I'm no lawyer, but I don't think I've ever seen DMCA used to take down an entire game because someone wrote a guide. I hope this doesn't establish any precedent, nor give people any ideas that "Oh hey, I wrote a guide close to what they did! I own it!" Curious if the fan/lawyer will argue it's theirs based on how other groups managed to get patents on loading screen minigames/etc. This also would be an exceptional highlight as to how generally broken DMCA reporting systems are, but I also don't imagine it changing due to the sheer volume of reports already. Going to be curious to watch this play out legally with Steam being an American company, the fan/lawyer being American, and the devs being in Europe.
