No need. Heatpipes are flexible and easily bend into and out of shape. It's easy enough to gently bend it back but there shouldn't be any significant impact to performance in the first place.

Without original receipt from previous owner, that would be nope. RMA requires proof of purchase. Plus, while Noctua has excellent customer service, physical damage is usually excluded from terms.

Out of the box is very different situations vs cooler that has been used over 6 months (minimum warranty period in EU). Out of the box its manufacturing defect and would have been caught at quality control. On used cooler its either mishandling or accidental. Either way, those aren't covered if part/device isn't rated to withstand forces which would cause such damage.
