Judging by your specs, you should be getting much more FPS, even with your current CPU.

 

Your motherboard is not good-enough for overclocking FX-8 core CPUs, even your current 4,4GHz overclock is pushing it.

Check whether your CPU is downclocking in games due to VRMs throttling, you can use HWinfo for that.

I doubt that, I was successfully running an FX-8350 @4,5GHz with an R9 290X (which are similar to what OP has power-wise) and I had no visible CPU bottleneck (GPU @99% in all games tested). What's more, Gamersnexus tested an FX-8370 @4,0GHz and it was capable of pushing 90FPS at Ultra (removing GPU bottleneck of course) so something is most likely wrong with his current setup. My first guess would be what I mentioned above.

Oh, make no mistake it will be like that as BF1 is CPU-heavy. My friend who plays BF1 with me has an i5-4690K @4,6GHz paired with a GTX 1060 6GB and even he's experiencing signs of CPU bottlenecking (ex. GPU usage dropping even to 60%).

My another friend has an old i7-870 paired with an RX 580 and he's getting around 60FPS at High/Ultra at 2560x1080 - That i7 is worse than your current CPU and runs BF1 better so it's likely something is wrong with the setup.

Have you checked your temps to see if anything is going wacky?

i dont think it is cpu temps thei are at 35 degres max

Check whether the clock speeds stay at 4,4GHz during gaming in BF1.

i am looking at rly jumpy ussage on the gpu mybe becouse i turned down the max temp to 82 but also rampt up the fan speed

You need to monitor that during gaming. A good tool to do it is using RivaTuner Statistics Server's (RTSS) On-Screen Display feature, that piece of software is built-in into MSI Afterburner and allows you to check out usage of the GPU, CPU, their clock speeds, temperatures and more. I suggest you download it and monitor it during gaming.

i am during playing i am playing in window so i can see it

So what is the average GPU usage when you play and what is the average CPU usage (per core)?

i ussually run full screen this was only for testing and in fullscreen i have the same issues

Then starting from the simplest steps, use DDU (Display Driver Uninstaller) to uninstall your GPU drivers and install them again (the latest one is 17.8.2 IIRC). Might be a GPU driver issue, looking at the GPU usage.
