It is a new operating system. So your Windows 7 would no longer be used. And yes, it is free.

its free until the beta runs out and then it starts to lock down the same thing happened with Windows 8 release preview.

That's up to you, just be warned that you'll have to reinstall Windows whether it be Windows 7, 8 or 8.1 when the preview ends.
