So my friend is selling off his CPU and Motherboard.  He has an I7-3770K which he had it overclocked by OC Genie for a year on an H100I and I think either an MSI GD65 Gaming or Mpower board.  He does a lot of video rendering, after effects etc and said for $350 I can have his board and CPU which I am going to do.  I also have been super lucky and I am gonna upgrade to an HD 9970.  I think his board is an Mpower and my case is the Rosewill Black Hawk so it's black with blue LED's.  What is the chances of an HD 9970 at launch coming from HIS or Sapphire non-reference?

Probably pretty good, but don't be surprised if it takes a bit. The 9970 apparently will outperform the 780 and Titan, but it will not be cheap. Not as much as a Titan or 780, but not as little as a 770 or 7970 either. You are lucky!

The estimated MSRP is 549.99 and with AMD I believe it.
