Hi, i was just wondering. 

I have the best graphics on, then i have overall 40 fps. If i have the worst graphics, i have also overall 40 fps.

Graphics card: GTX 970 

I use MSI Gaming app to use OC Mode(Overclockmode)

RAM: 16 GB DDR3

SSD: Samsung evo 850
My CPU: Intel Core i5 650

Could it be my cpu affecting this?
I dont have v-sync or anything like that. 

And if i it is the CPU, would i7 875k be worth the upgrade? Because i dont want to switch motherboard.
I have a LGA1156 Socket

Yes. GTA V is pretty CPU-intensive, and that behavior is a classic symptom of CPU bottlenecking. It's not conclusive, but pretty likely. You can check your GPU utilization, if it's dropping well below 100% then it's the CPU bottlenecking things.

I think you mean the CPU being at 100% all the time and GPU usage being low.

The CPU doesn't have to be at 100%, because it can bottleneck without being reported at 100% load. It's much easier to see in the GPU load, which should normally be pegged pretty close to 100%. As I said, if it's dropping well below 100% then the problem is most likely a CPU bottleneck.

A GPU pegged at 100% would mean it's not held back by the CPU, you have it backwards.  A CPU bottleneck would show exceedingly high CPU usage while the GPU struggles cos it's not getting fed by the CPU.

Honestly id suggest atleast a haswell i5

You have the i5-650 that's a dual core, right? Then one of the quad cores, like the i7-875K, might be a nice upgrade. Maybe just a cheaper i5-750 that you then overclock. But I'd only recommend it if you can find a decent deal, if it's expensive then you might as well upgrade to Haswell/Skylake and get that much more of a boost.

You're just reading my post backwards. I'm literally saying the same thing - a CPU bottleneck would show the GPU utilization dropping because it's not getting fed by the CPU.

Change your CPU to a quad core, the i7 would be great

 

My i5 3470 is bottlenecking Gta 5 like hell, at 6048x1200 highest settings i get 55-60 with 70% GPU usage on the r9 290
