laptop crash

Hey everyone, just got a new laptop for Christmas, a Toshiba one. When I first went to turn it on it wouldn't power up, however after plugging it in it started up, despite the fact it said it was at 100% charge. During the windows setup for 8.1, it froze numerous times and crashed, after a few attempts i got into windows at the desktop, but after a maximum of about 5 minutes, the laptop will either crash and restart or the screen will go a sort of staticy pink and blue but still have windows visible in the background before it either freezes or just crashes and restarts. If anyone knows what could be up or has a solution to this or suggestions, it would be greatly appreciated.
