Is this correct? Preactivated Windows 7

OK, I bought a laptop from a seller who sells other various electronics, has  a 100% feedback in the hundreds.

 

However, issue is I the laptop didn't have a Windows disc, so he eventually got round to it and send me a preactivated.iso?. Isn't this wrong to do?., I was going to complain but I thought I ask here first before making a fool of myself.

depends on the ISO really. it might be wrong, tough it might be legit too. ask him where he got it

how can I tell if its oem?

If it's already installed, go to the System/(place where you check CPU RAM and Windows version) and if there's a logo of your laptop manufacturer then it's likely legit. You still have to use a legitimate product key though
