GTX 960 No frame difference between playing low and ultra

Sounds like a throttling issue.

If any of your cores are reaching max usage. They may or may not. Either way, the intel cpu's typically have better single core performance, over the amd cpu's. A lot of games only use one or two cores.

So to wrap it all up, I can't play Battlefield 3 over 40 fps -_-?

I have an FX-9590 and a R9 290X and my FPS on Battlefield ranges from 75-120, you probably had a faulty CPU or Motherboard.

But it is only with BF3, That is the strange thing about it

Have you tried reinstalling Battlefield 3, I've seen people play the game on ultra with setups exactly like yours at over at least 60 fps.

Origin tracks your progress as far as I'm aware, if your worried you could make a backup of the game and your save an then re-download it. If it only happens in Battlefield 3 then my first guess would be that it's to do with the game.

Then I don't know what you can do, there will be a problem somewhere, though it's probably a software issue rather than a CPU or GPU issue as your system is more than capable.
