I have my Intel Core i5 4670K overclocked to 4.4 with a Hyper 212 Evo at 1.35V (my CPU is bad at overclocking at low voltage) I am currently getting around 70-75C on core 1 on Assassin's Creed 4 at 100%. Is this okay or will it damage the CPU?

70-75 is okay, but if I were you I'd try to get a bit lower - personal preference.

It should be safe,

The problem is I really can't go any lower or it will be unstable and crash.

You could lower the clock speeds...

I think even 4.2 or 4.3 should be more than enough for any game right now.

It's only worth it if you're playing games AND streaming/recording, otherwise there's no point getting an i7. you'd literally only see like 1-2 frame increase, that's it.

Are there any benchmarks comparing the two? (4670 and 4790)? I have heard from some people that having an i7 would benefit games and some people who say that it wouldn't.

Cheekboys, just buy the damn i7-4790k already.  You're clearly unhappy with your i5, even though you have no "legitimate" reason to be. Not getting an overclock that you like is a bad reason to spend money on something that won't give you any real performance gains.

You post something what seems like once a week.  The answer hasn't changed.  You have an unlucky chip, doesn't mean you need to change processor.  If you really want, buy better cooling, but 75C while gaming is ok.  Its on the high side, but its ok.  85C and below is ok for 24/7 use, so don't fret.  Keep your i5 + Hyper 212 EVO, there is no reason to upgrade.

1.35V is 0.05V higher voltages than what are rated safe on that CPU. Its your money, but I'd lower both clocks and voltages. The difference in the end isn't much worth if you crap CPU because of it.
