Sup guys i need some help

I recently ordered an i3-6100 processor from an online store and the processor arrived and the PC failed to turn on with it, and after a light analysis I came across a possible problem
the processor came insufficiently wrapped and already taken out of the original packaging and only thrown into an antistatic bag with thermal paste and the bag glued to the cooler wrapped in bubble wrap
there are cracks on the processor that I could not cause with informed handling

 

what do you guys think can i do something or should i try for refund?
