Some games just don't use it due to issues in the system itself, i.e. drivers. There's also your example being one game, Gmod, that can run on a potato and the Witcher which needs all it can get for the graphics settings.

Sure just sell license and who gives a shit what that does on the market... as long you have computing power "3x above minimum requirements" that you overpaid. All good! 60 fps god's standard. But who ever played game for real knows 60fps is unplayable shit.
