Currently playing at 1440p with 60hz refresh rate and just want to get a little bit more fps wise then what I can get now with my 1070 but not sure what I should upgrade outside of gpu or which gpu would be a nice step up without blowing my budget. 

actually id keep the 9900k, and depending on the psu go for maybe a 9070xt or even a 3080 since they only go for 400 used

Ok I have a friend selling a 3080 that I was considering buying if the price is decent. PSU will need an upgrade I don't remember the brand but I think its a 650 will have to check.

650w is good enough for a 3080 and 9900k (just checked a psu calc). but yeah def check out the 3080

Welcome back to the forums!
I'd say that the 9900K is a perfectly good CPU for 1440p and will be for several years. It's not worth it to upgrade right now. I'd focus on GPU. 3080 is a great card
If you do need to upgrade the PSU, make sure to get something at least B tier from this list
