A weird ebay situation...Need help.

Alright so a few weeks back i won a auction on this item: http://www.ebay.ca/itm/161273407033?ssPageName=STRK:MEWNX:IT&_trksid=p3984.m1439.l2649

 

The title was "Razer DeathAdder 2013 Edition Ergonomic Gaming Mouse Brand New Without Box!" 

and the description had the MPN: 258321700 which is the MPN for the 2013 edition and the title/desc is more important than the picture when it comes to ebay so i figured he just used the wrong pic. Either way i tried messaging him before i won the auction and after and this is how it went.

Hi are you sure the mouse is the 2013 edition? From what i understand the razer deathadder 2013 edition has side grips on both sides but i don't see them on the picture?

Hi. I figured i would just message you again in case you didn't notice my message but are you sure this is the 2013 edition of the deathadder? The 2013 edition has rubber grips on both sides of the mouse but in the picture this doesn't. Hopefully you can reply before the bidding ends, Thanks.

This is just overstock from a store. They have the blue light. That is all I know.

Yea if it has a blue light it's deathadder 3.5G or even the 3G. The 2013 edition is much different (Logo and scroll wheel are green, Side buttons are different, Different coating, Rubber grips on sides, Different mouse wheel, Upgraded sensor with higher DPI etc)

I'd like to cancel my order if you don't mind since i'm shopping for the deathadder 2013 edition. You also might want to change your title and description to describe the actual product otherwise you might have a lot of people complaining/asking for refunds when they receive a product different than described.

So a couple weeks pass and i keep getting these e-mail from ebay saying "Hey don't forgot to pay for the item you won!" and 2 mornings ago i get a e-mail from ebay saying "Your item has been shipped". But wait, I haven't bought anything recently? Turns out the guy shipped the mouse and i haven't even paid for it (nor do i want to). It's not just marked as shipped either it has the tracking number so it should be here in a few days.

 

What should i do in this situation?  Should i phone ebay and explain the situation? Or should i just let him ship me the item and accept that he's an idiot and see how it goes from there?

lol free mouse? wtf , his problem  but he may be like this man never payed for his item, but your in the right because you never payed IMO

Refuse the package, and send a message to the buyer informing him of what he has done, and what you plan to do.

 

This way if it gets escalated to ebay, they can see where you tried to avoid the situation and do the right thing.

Refuse the package when it's delivered and contact Ebay asap. I'm pretty sure they're trying to draw you into a legal situation where you'll owe them more money.

 

But I could be wrong entirely.

One problem though is i can't refuse delivery because with all small packages from Canadapost i get a little letter with a key in my mail box which i then use to open the bigger box to get small packages. I almost want to just accept it and see what happens because i feel like he is in the wrong and worst case scenario he pays for return shipping (if he even wants it back, i forgot to mention he sold 50+ of these mice).

 

That being said i think i will just phone ebay and see what they have to say. Thx guys.

If the item arrives and doesn't require a signature then just keep it. If a signature is required then reject the goods.

If it didn't need a sig I would then message him and say that if he wants it back I will send it so long as he pays postage up front or arranges his own courier collection.

Regardless of a signature required or not, there is still proof of delivery. If you can't refuse the package on the spot, take it back to the courier from which it came and inform them you are rejecting the shipment.  They'll return it to you.

 

Keeping the item is stealing. Even if he doesn't go after you, just keep that in mind.

I assume you are have no legal obligation to return it otherwise people on eBay would be sending out stuff all the time to anyone who asked a question.

 

It seems to me like a moral decision, in a perfect world you would contact the seller and explain.
