You can see in the benchmark. He's running a i9 10850k on a Z490 mobo and I'm running a i7 12700k on a Z690. Is it possible that the psu could be the issue and somehow my power delivery isn't working right? Or maybe something in the Nvidia control panel? I would think power would be the issue since my parts are better besides the ram. 

 

I also just got a 4070ti which is also underperforming quite a bit. That's why I suspected the issue and tried my 3080ti in another pc.

Do you know what your PSU is and what your brother's is? Also does your case maybe not have a good way to deal with component heat? I'm not particularly experienced with computer hardware but that would be my first guess.

His is an Apeva 800watt and mine is a corsair rmx 850 watt which is a much better cpu. Unless it is faulty in some way. My temps are good too so I don't think that's the issue.

Your GPU score seems OK but your CPU score seems to be low when comparing with equal systems (GPU and CPU).

Can you make a screenshot of the hwinfo summary dialog.

Does your memory perform well?

Have you checked your CPU temps and CPU speed while running performance test?

I use furmark's CPU burner for quick testing CPU and GPU temp's on load and if the CPU is throttling caused by high temp.

 

On my system where I upgraded the CPU yesterday the AIO I used from the old system can not keep the CPU cool enough that it can run at full turbo speed (4800Mhz) instead it reaches immediately 90°C and throttles the CPU speed to 4550 MHz. I have already order a bigger AIO cooler and hopefully the CPU can then perform in full turbo speed.

That does not look to bad. It looks good.

When comparing your values with the official Intel spec for the 12700K it is good.

CPU-Z shows P-Cores freq. 4688 Mhz of possible 4900 Mhz 

and for E-Cores 3591 Mhz of possible 3800 Mhz

 

But there is some room for more. Temps are good so why not getting full turbo speed?

Your CPU supports "Intel® Turbo Boost Max Technology 3.0 Frequency". Maybe you can check in BIOS if this is enabled (OC Tweaker - CPU Configuration).

Be sure you know how to reset CMOS when playing around with overclocking settings so you can go back to a stable state. "Intel Turbo Boost Technology" and "Intel® Turbo Boost Max Technology 3.0 Frequency" should be safe to change.

 

There should also be settings for thermal thermal velocity boost (below 70°C). Check following article https://www.intel.com/content/www/us/en/gaming/resources/how-intel-technologies-boost-cpu-performance.html for a description.
