Need advice

I bought an iPhone yesterday that had been listed as stuck in recovery mode upon trying to restore it i got an error 1 form iTunes basically meaning that the phone had been jailbroken in the past and something went wrong so do i have a claim in that it as listed as stuck in recovery mode but it had not been mentioned that the software had been tampered with which is in violation of the misdescription act of 1991 so is there potential that i will get my money back any help is much appreciated
