its a laptop but it should not be at 85c in idle what brand and model?

That is very not normal for any laptop does it thermal throttle when gaming?

Nope for gaming laptops its expected to go to ~90c

assuming an all core load it might be, but I don't think it's too severe however I'd bring the laptop back, that kind of high temperature is not normal, and if it is for that model, I'd look for a refund. Something is not right with the cooling system. 85°C at 10ish% load is very not good.

If it can get to 100c get a refund I can't find any reviews on it but that cooling system is bad

If you're stuck with it, and you think the TIM isn't good, I'd recommend repasting it.
Modern CPUs with boost clocks don't throttle until 105°C however, that's not the whole story. the CPU will lower the boost speeds it uses as it gets hotter, thermal throttling doesn't happen until the clock goes under the base frequency by definition, so it's not thermal throttling but it's losing some boost speed.

Ok, I looked deeper into reviews and such, and some of the reviewers complained about the thermals being complete shit, but apparently it seems easy to fix, well maybe not easy but not too difficult either. Apparently it just needs 10 philips head screws and the whole bottom comes off. The cooling system doesn't seem that bad, so it's possible new paste if you're brave enough would help bring down the thermals a bit. You can also use something like Intel XTU or throttle stop to undervolt the CPU.
