Hey just bought some new parts for my system I got a i5-8600k, a msi z370 gaming plus Mobo and a kit of 16gb g skill 2400mhz ram.

I have ran a few memtests because I seen some stuttering in assassin's Creed origins which is only present sometimes and sometimes goes away when I reboot my system. But I decided to memtest to see everything was good and currently in the test it's doing as I write this it has 123 errors I just let memtest run itself to get these results. Now I am wondering are these errors critical and should I be taking this ram back to the store in which I bought it getting these errors. Also will a store even refund ram that works but just gives some errors that I found testing?

Put it back to 2133 and run the tests again.

Possibly, but when all you do is change the speed from 2133 to 2400, there could be timing changes that need to happen, sub timing changes and possibly voltage changes. if your board supports it, you could enable XMP and test as well as that should change all those things for you.

Well I went into BIOS and loaded optimized defaults and I instantly got like 7 errrors when running memtest again. Also at the end of what seeems to be the error string it says CPU 4 not sure if that's important.

Confirm in your BIOS that your RAM is set to 2133 and not XMP. Its showing that you have XMP enabled.

Yes, but its safe to run RAM at 1.35v 24/7 as that is what it boosts to with XMP. So lets just test it.

Could this possibly be a problem with my settings not saving correctly because even when I tried overclocking this CPU my windows didn't report my actual clock speed in properties like my old 4690k did it would show on could and hwmonitkr but thought was strange nontheless

Windows never reports it correctly. Dont use windows as a gauge if you are showing correctly. Use something like HWinfo to check.
