Surface Pro 4 pen/screen problems

My surface pen/screen starting acting up today, while the pen was hovering over the tablet, it started to write things as i moved around my palm. AND occasionally it registered both my palm and the eraser end of the pen as the tip and made my notes look like confetti, and ideas on whats wrong?

Maybe the pen's battery is dying?
