I recently bought an iPhone 5s and the seller said its a 16GB phone, but when I open the storage, I saw it said "available: 23.5GB, used: 3GB"

 

If this is a 32GB model phone, why is it said 26.5GB?? Where's the unused 5.5GB?? 

 

If it's a 16GB model, why does it has extra 10.5GB?

That is for the "OS" 

basically its / and that's where the OS and important information lies. Your apps and stuff are in /var

A few people tried and failed to sue a few phone manufacturers over this a couple years back.  

 

The phone has the amount of storage advertised.  However they still have to install the OS and basic apps. These take up various amounts of space depending on your OS and carrier.  

 

There is no problem at all.  It is like complaining that your 256GB SSD doesn't have 256GB free after you install windows.
